The New Jersey justice system allows inmates the opportunity for release upon serving a mandatory parole ineligibility period. For example, a person convicted of manslaughter must serve at least 85 percent of the sentence before appearing at a parole hearing. A lesser crime, such as shoplifting or drug possession, has a much shorter ineligibility period.

We may request a probation violation hearing in order to present our defense to the court. These hearings are like mini-trials in which your lawyer presents evidence, witnesses and oral arguments to prove you did not violate the terms of your probation. However, the prosecutor must only prove you violated your probation by a preponderance of the evidence, a much lower standard than beyond a reasonable doubt required to convict you for the original crime. The judge may revoke your probation and order you back to jail, allow you to resume the terms of probation or alter the terms if your compliance is truly no longer feasible.
